About Port Byron Agenda Attachments and the 2012 Open Meeting Law:

As of February 2, 2012, Gov. Andrew Cuomo signed legislation that requires state and local governments to post materials online before a meeting, or provide copies before or at the meeting when possible. The new law applies to records scheduled to be discussed during an open meeting, including proposed resolutions, laws, rules, policies and amendments.

Participation in Meetings

The Board of Education welcomes your comments, concerns, and questions. The agenda provides an opportunity for residents to address the Board on any topic during the public comment portion of the meeting. An individual board member has no more authority than any other qualified voter of the district. It is only when acting as a body, that the Board has authority. Effective responsible consideration of an issue by the Board is best accomplished when it is scheduled in advance as an item on the meeting agenda.

Therefore, while comments and questions are welcomed, the Board will generally not respond to items introduced during the public comment period. Rather, these non-agenda items will be referred to the President and Superintendent for consideration as an agenda item at a future meeting. Additionally, these items may be referred to administrators or staff members who may be able to assist and report back to the Board at a later meeting.

Meetings are held in public, but they are not public meetings in the same sense as traditional town meetings. Therefore, members of the public generally do not participate in the business of the Board after the public comment period. Those who have comments they would like to make after the public comment period are always invited to call or write Board members or to comment during the public comment period at the next Board meeting.

Meetings

A schedule of Board of Education meetings is below. Meetings are held at 7 p.m. in the Lehn Library. When there is a change of date or location of a Board meeting, press releases will be sent to the news media and posted on the district’s website. Special meetings may be held by the board as often as necessary to conduct school district business. When possible, such meetings are announced at least 24 hours in advance and the meetings are open to the public.

Executive Sessions

Executive sessions (meetings from which the public is excluded) are permissible for such specific purposes as: proposed, pending or current litigation; collective negotiations; medical, financial, or employment matters concerning a particular person; the proposed acquisition, sale, or lease of real property; sale of securities; preparation, grading, or administration of exams; and matters which might imperil public safety.
Residents may address the Board during public session. Comments are asked to be concise and limited in time.

Board of Education Elections

Persons wishing to seek election to the Board of Education must obtain petitions from the District and file them no later than 5 p.m. thirty (30) days prior to the date of the election. Petitions must contain at least 24 signatures or 2% of the number of persons voting in the last election. The Board of Education consists of seven (7) members. Terms of office are three (3) years.
